By using our website, submitting a contact form, requesting an estimate, or entering into a service agreement with Lawn Spa Landscaping Inc., you acknowledge that you have read, understood, and agree to these Terms. Your continued use of our website or services after modifications are posted constitutes acceptance of the revised Terms.

Services

Lawn Spa Landscaping Inc. provides landscaping, hardscaping, pool installation, snow and ice management, drainage, excavation, masonry, hydroseeding, landscape lighting, fencing, and related outdoor services to residential and commercial properties in the Hudson Valley region of New York. The specific scope, timeline, and cost of any project will be outlined in a written estimate or service agreement provided to you before work begins.

We reserve the right to subcontract portions of any project to qualified professionals when necessary to complete the work. We remain responsible for the quality and completion of all work performed under our agreements.

Estimates and Proposals

Estimates provided by Lawn Spa Landscaping Inc. are based on the information available at the time of the site evaluation and are subject to change if site conditions differ from what was observed or disclosed. Estimates are valid for 30 days from the date issued unless otherwise stated in writing. An estimate does not constitute a binding contract until you accept it in writing or authorize work to begin.

Additional work beyond the original scope must be approved by you before we proceed. We will provide a supplemental estimate for any additional work and obtain your approval before performing it. Changes requested during an active project may affect the project timeline and total cost.

Payment Terms

Payment terms are specified in each service agreement or estimate. For larger projects, we may require a deposit before work begins, with the balance due upon completion or according to a milestone schedule outlined in the agreement. Recurring maintenance services are billed monthly or per service, as agreed.

We accept payment by check, cash, credit card, and electronic transfer. Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance. If an account remains unpaid for more than 60 days, we reserve the right to suspend services, engage a collection agency, or pursue legal remedies to recover the amount owed, plus any associated collection costs and attorney fees.

Scheduling and Access

You agree to provide reasonable access to your property for the performance of services, including access for equipment, materials delivery, and crew members. Project schedules are estimates and may be affected by weather, material availability, permitting delays, or unforeseen site conditions. We will communicate any significant schedule changes as promptly as possible.

For snow and ice management services, response times are best-effort targets and may be affected by storm severity, road conditions, and the number of properties requiring service during a storm event.

Limitation of Liability

Lawn Spa Landscaping Inc. will perform all services in a professional and workmanlike manner. However, our total liability for any claim arising from our services shall not exceed the total amount you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, lost profits, or damage to property not directly caused by our negligence.

We are not responsible for damage to underground utilities, irrigation lines, septic systems, or other subsurface features that were not disclosed to us or marked before work began. You are responsible for notifying us of all known underground features and for contacting the appropriate utility locating service (811) before excavation work begins.

Plant material is a living product and is subject to environmental factors beyond our control, including weather, soil conditions, watering, pest pressure, and disease. We do not guarantee the survival of plant material unless a separate warranty is provided in your service agreement.

Cancellation Policy

You may cancel a project before work begins with written notice. If materials have already been ordered or custom-fabricated for your project, you may be responsible for the cost of those materials. Once work has begun, cancellation may result in charges for labor and materials already expended, plus a reasonable restocking or disposal fee for unused materials that cannot be returned.

Recurring maintenance contracts may be cancelled with 30 days written notice. Services performed before the cancellation takes effect will be billed at the agreed rate.

Intellectual Property

All content on this website, including text, images, graphics, logos, and design, is the property of Lawn Spa Landscaping Inc. or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any content on this site without our prior written consent.

Dispute Resolution

If a dispute arises regarding our services, we encourage you to contact us directly so we can work toward a resolution. If we are unable to resolve the matter informally, any legal action shall be brought in the courts of Orange County, New York, and shall be governed by the laws of the State of New York. Both parties agree to attempt mediation before pursuing litigation.

Indemnification

You agree to indemnify and hold harmless Lawn Spa Landscaping Inc., its owners, employees, and contractors from any claims, damages, losses, or expenses arising from your breach of these Terms, your misuse of our website, or your failure to disclose relevant property information that affects the safe performance of our services.
